PURCHASE OPTION CANCELLATION POLICY

This Purchase Option Cancellation Policy applies to subscriptions, regular deliveries and other recurring purchase options offered on mygellies.com by:

1. Principle of the recurring purchase option
Some Gellies products may be purchased through a regular-delivery option or subscription. By selecting this option, the Customer asks Gellies to automatically generate new orders at the frequency selected from those offered at the time of subscription.
Each renewal involves the creation of a new order, payment of the price applicable to that order and, after processing, shipment under the applicable delivery conditions.
The subscription has no minimum commitment period unless expressly stated before subscription. The Customer may end it under the conditions below.
2. Authorisation of recurring payments
By subscribing to a recurring purchase option, the Customer authorises use of the payment method on file to pay automatically for orders generated under the subscription.
The Customer remains responsible for maintaining a valid payment method. The amount charged is the price applicable to the renewal, increased or reduced, as applicable, by taxes, discounts, fees or delivery benefits.
3. Delivery frequency
The applicable frequency is the one selected by the Customer from the frequencies offered on the product page or in the customer account. Frequencies offered to new subscribers may change.
When available, the Customer may change the frequency at account.mygellies.com. A change applies only to future orders that have not yet been generated.
4. Reminder before renewal
Gellies plans to send a reminder before the next recurring order, generally four to seven days before the scheduled renewal date. The reminder allows the Customer to review and, if desired, change, postpone or cancel the subscription before the next order is generated.
The Customer is responsible for keeping a valid email address and checking messages. If a reminder was correctly sent to the address provided, failure to receive it because of spam filtering, a full inbox, an incorrect or outdated address, a mail-provider issue or circumstances reasonably outside Gellies’ control does not by itself cancel a validly scheduled renewal.
5. Managing the subscription
The Customer may manage the subscription at account.mygellies.com or request assistance from contact@mygellies.com.
Depending on the available features, the Customer may cancel the subscription, postpone an upcoming order, change the frequency, quantities or certain products, update the delivery address and update certain payment information. Any change must be made sufficiently early before the next order is generated.
6. Cancellation deadline
To prevent the next order from being generated, the Customer must cancel, postpone or change the subscription no later than 24 hours before the scheduled generation date of that order.
A request received after that deadline may no longer be executable for the immediately following order. This limit is necessary because order processing, payment and transmission to the logistics system are automated.
7. Order already generated
Cancellation of a subscription does not retroactively cancel an order already generated.
Once a recurring order has been created by the system in accordance with the Customer’s active subscription, it is a separate order and remains due, following the normal preparation and shipping process, except in the event of a technically accepted cancellation, an error attributable to Gellies, a mandatory legal provision or the valid exercise of a legal right applicable to that order.
Simply cancelling the subscription after the order has been generated is not cancellation of that order.
8. Order being prepared or sent to the logistics system
Orders are processed automatically. Once an order has been validated, sent to the logistics system, is being prepared, packaged, handed to the carrier or shipped, Gellies no longer guarantees that a technical cancellation is possible.
The Customer may promptly contact contact@mygellies.com; Gellies may try to stop processing when technically and reasonably possible. This is an operational courtesy, not a contractual right to immediate cancellation.
9. Effect of cancellation
A cancellation made validly within the applicable deadline prevents future renewals. Cancellation has no cancellation fee, requires no explanation, does not affect previously fulfilled orders, does not automatically refund an order already generated and does not undo a payment for an order already validly created.
After cancellation, no new order should be generated after the last order already committed to the process, unless the Customer voluntarily subscribes again.
10. Postponing an order
When available, the Customer may postpone an upcoming delivery. The postponement must also be made no later than 24 hours before the scheduled generation of the order.
A postponement requested after generation does not guarantee that the order can still be stopped. Postponing one due date does not cancel the subscription; unless stated otherwise, the subscription continues under the new schedule.
11. Changing quantity or product
When the Customer voluntarily changes the quantity, product, recipe, frequency or another subscription characteristic, the conditions displayed and accepted at the time of the change apply to the affected future renewals.
A change made after an order has been generated does not alter that order retroactively.
12. Subscription price
The products’ base price may change during the subscription. A recurring purchase option is therefore not, unless expressly stated otherwise, a perpetual guarantee of the product’s base price.
The price for future renewals may be calculated using the current product price with the contractual subscription benefit applied. Any price change for a future renewal is communicated before it applies so that the Customer can cancel before the relevant order is generated. If the Customer does not wish to accept the new price, the subscription must be cancelled before the applicable due date.
13. Subscription discount
The applicable discount is the one announced at subscription. On the date of this Policy, some regular-delivery options provide, in particular, a 15% discount.
Benefits offered to new subscriptions may change. The Customer should always refer to the information shown on the product page at subscription. A benefit expressly included in the subscribed terms is not changed retroactively for orders already concluded, although a voluntary change of the offer or subscription may apply the conditions of the new option.
14. Free delivery
When a subscription benefits from free delivery, it applies under the conditions communicated at subscription or when the relevant change was made.
On the date of this Policy, some orders may qualify for free delivery from the number of packs indicated on the Site. If the Customer voluntarily changes the subscription so that the free-delivery conditions are no longer met, applicable delivery charges may be added to future renewals.
15. Payment failure
If payment for a recurring order fails, Gellies or its payment provider may make one or more reasonable further attempts. Shipment may be suspended until payment is received.
In the event of continued failure, Gellies may suspend the order, suspend the subscription or end the subscription. Gellies is not required to ship an order for which payment has not been received.
16. Expired or invalid payment method
The Customer is responsible for keeping the payment method up to date. Payment may be impossible because of an expired or blocked card, a reached limit, a bank refusal or outdated payment information, which may delay, suspend or cancel the relevant renewal.
Gellies is not responsible for consequences directly attributable to refusal of the Customer’s payment method.
17. Product unavailable
A subscription does not guarantee absolute and permanent availability of a product. In case of temporary unavailability, Gellies may postpone generation or shipment of the next order.
In case of lasting unavailability or a substantial product change, Gellies may suspend or cancel the subscription. No substantial substitution with a different product is made without the Customer’s consent.
18. Ending or changing a subscription option
Gellies may stop offering a subscription option in the future. If a change substantially affects an existing subscription, Gellies will inform the Customer within a reasonable period before it applies. Where the law requires the Customer’s consent, the change will not be imposed without that consent.
Gellies may also end a subscription for a legitimate reason, including fraud, abuse, persistent payment failures, a lasting impossibility of performance, permanent product unavailability or a legal or regulatory obligation.
19. Stock remaining with the Customer
The Customer chooses the frequency and quantity of recurring orders. Gellies does not guarantee that the previous order will have been fully consumed before the next renewal.
Having products remaining when a new order is generated is not a service defect, does not automatically cancel the order and creates no special right to a refund. The Customer must postpone, change or cancel the subscription before the applicable deadline if no new order is wanted.
20. Change in the animal’s treatment
Changing or stopping an animal’s treatment does not automatically cancel the subscription. The Customer must manage the subscription when the product is no longer needed.
Subject to mandatory rights, an order already generated is not refundable solely because the treatment stopped, the medicine changed, the animal no longer needs treatment, the Customer still has products or the animal’s needs changed.
21. Right of withdrawal
Future cancellation of a subscription and the legal right of withdrawal are separate mechanisms. Cancellation prevents future renewals under these conditions.
Where it exists, the right of withdrawal is exercised under applicable law, the General Terms and Conditions of Sale and the Return and Refund Policy. Distance sales generally benefit from the legal right of withdrawal subject to legal exceptions, including those that may concern certain food products or opened sealed goods. Nothing in this Policy limits a withdrawal right that is mandatory.
22. Opened or unsealed products
The rules for opened, unsealed, perishable or health- or hygiene-sensitive products are set out in the Return and Refund Policy. Cancelling a subscription creates no additional right to return a product that cannot legally be returned.
23. No automatic refund
Cancellation of a subscription does not automatically refund previous or already generated orders.
No commercial refund is due solely because the Customer forgot to cancel, did not read the renewal reminder, still has products, changed their mind, no longer needs the product or failed to make a change before the 24-hour deadline. This is without prejudice to the Customer’s mandatory legal rights.
24. Exceptional cancellation by Gellies
At its discretion, Gellies may exceptionally stop or refund an order even where it is not contractually required to do so. This commercial gesture creates no acquired right, acknowledges no legal obligation, does not amend this Policy and does not require Gellies to make the same decision in another situation.
25. Abuse
Gellies may suspend or cancel a subscription where objective evidence reasonably indicates fraud, abusive use of promotions, fraudulent payment disputes, manipulation of the subscription system or conduct clearly contrary to these conditions.
Orders legitimately due before the suspension or cancellation remain subject to the applicable rules.
26. Confirmation of cancellation
After cancelling online, the Customer should check that the customer account correctly shows the subscription as cancelled or inactive. For an email request, processing depends on receiving it sufficiently early before the applicable deadline. The Customer should retain the cancellation confirmation or related communication.
27. Customer account data
The Customer is responsible for keeping the information used for the subscription up to date, including email address, delivery address, payment method and other useful contact details.
Changing contact details after an order is generated does not automatically change that order’s information.
28. Changes to this Policy
Gellies may change this Policy for the future, including to reflect changes to subscription operation, technical developments, regulatory changes, a change of provider or new features.
A later change does not alter an order already concluded retroactively. Where a change substantially affects an existing subscription, the Customer will be informed in accordance with applicable legal requirements.
29. Mandatory rights
Nothing in this Policy is intended to remove, reduce or make excessively difficult the exercise of a mandatory right granted to consumers by applicable law.
If a provision conflicts with a mandatory rule, that rule prevails without affecting the validity of the other provisions.
